These Terms of Business are an agreement between the Driving School (Instructor) and you the Pupil (Client).
1. You must be of legal age to drive and be able to produce a valid UK/Northern Ireland provisional Category B driving licence. For Motorway, Pass Plus or Refresher Lessons, a full valid licence must be produced. You must meet the minimum eye test requirements, which means you must be able to read a standard UK approved number plate at a minimum distance of 20.5 meters (67 feet). If you need to wear glasses or contact lenses in order to meet this requirement then you must wear them whenever you drive.
2. You must notify your instructor of any change to your ability or entitlement to have driving tuition, for example, if your provisional licence has been revoked or for medical reasons such as epilepsy or any other reason. You must also notify your instructor if you have any points or endorsements on your licence prior to commencing tuition. You must not drive at any time during your tuition course without disclosing any points or endorsements. The instructor reserves the right to refuse tuition dependent on any unlawful driving in or out of the instructor vehicle.
3. You must not be under the influence of drugs/alcohol during the training. In the event of there being any signs of drugs/alcohol misuse, your instructor will terminate the lesson and you will be barred from any future training. Any money you have paid your instructor will be forfeited and no refunds will be given. Any prescribed medication that may affect your driving must also be declared to the instructor and to the DVLA medical board. Failure to do so will result in the lesson being cancelled and no refunds will be given.
4. If you wish to cancel a lesson then a minimum of 48 hours notice is asked. Last minute cancellations can result in the lesson having to be paid for in full. Lessons can be cancelled by telephone, text message, email, Facebook, Whats App but must be acknowledged by your instructor. If a lesson can be moved to another time in the same week then no fine will be charged. If pre-paid lessons are suspended for more than four weeks without your instructor's prior consent or the block is not completed within 6 months, then the remaining fee will be forfeited and no refunds will be given. If tuition is cancelled by the pupil part way through a block there is no obligation to refund any moneys paid, any refund given is at the discretion of the instructor, will be based on exceptional circumstances and will involve a £5 reduction on any lessons returned.
5. Your instructor will endeavour to arrive on time, however, due to unforeseen circumstances such as breakdowns, accidents, and traffic hold ups etc, lesson times may need to change or even be cancelled. If your instructor is late the time will be added to the end of the lesson, or to a future lesson at your convenience. If cancelled by your Instructor, no fee will be charged.
6. Your instructor will arrive at the pre-arranged pick-up point for your lesson and you will be given a 10 minute waiting time. After 10 minutes if you have not shown up they will leave and you will have to pay for the lesson in full before future lessons can be continued.
7. Lessons must be paid for in advance or on the day by cash, cheque or BACS Transfer. In the event of late payment, a charge of £5 will be made for every week the payment is outstanding.
8. A decision will be made between the pupil and instructor as to when the best time to book your driving test will be. This will be based on the instructorsʼ satisfaction that the pupil is of a high enough standard of road safety, and the pupils own confidence in driving. If, after the test has been booked, the instructor feels more time is needed to prepare then the test will be rescheduled for a later date. The instructor's decision is final and he reserves the right to refuse the use of the tuition vehicle for the test.
9. Whilst on the test, the driver is responsible for the condition of the car. The instructor reserves the right to charge for any damage caused.
10. While the instructor will endeavour to provide a dual controlled car for the test there is no absolute obligation to do so. No responsibility can be taken for tests cancelled by the DVSA for whatever reason and the instructor may still need to be paid for his time. You will be given a free retest by the DVSA. If the test has to be cancelled by the instructor due to unforeseen circumstances such as weather, vehicle breakdown or illness as examples there will be no liability on the instructor. When practicably possible the instructor will give three days notice.
11. Being a learner driver does NOT offer exemption from the laws of the road. As such, any penalty points or fines received whilst on a lesson or test are the sole responsibility of the driver.
12. In no circumstances will the school be liable for any loss or damage if, and in the event, such loss or damage is caused by the pupils failure to comply with these terms of business or the instructors reasonable instructions.
The aggregate liability of the school for direct loss resulting from the school’s default will be limited to £50 per claim.
The school will not be liable for the losses, costs, claims or expenses arising as a result of any event which is outside the school’s reasonable control or expectation.
The school will not be liable, whether based on contract or tort, or on any other legal or ground for any consequential, indirect or incidental loss of whatever kind and however caused.
